Definitions

1. In these Terms and Conditions
a) "You", "your", "advertiser", refer the any person or organisation advertising on the site;
b) "We", "Us", "Our", "Publisher" and "Hotmat" refer to Hotmat Limited, England, UK;
c) "Site", "website" and "UKPAD" refer to the web site provided by Hotmat whose url is www.ukpad.com.

Advertisement

You confirm and warrant that the details, description, information and any images submitted for publication by Hotmat on the Site are true and accurate and contain no false statements, misrepresentations or omissions which may mislead any interested parties.

You agree that you are solely responsible for the content and accuracy of any advert that you post on the Site.

The copyright for all purposes in all artwork, copy and other material which the Publisher or his employees have originated, contributed to or reworked shall vest in the Publisher.

Publication, Cancellation & Refunds

The rate payable for insertion of any advertisement shall be in accordance with the Publisher's rates calculated and displayed during the booking process.

Your advert will be published within one working week of clearance of payment of the Fee. Please note that once your advert is published, our service is deemed to be fully delivered and we are unable to offer a refund for any reason.

You may cancel your advert for any reason at any time. If we have received a cancellation after payment has been accepted then we will not be able to issue a refund. If cancellation is received before payment is accepted then no payment will be taken and your advert will be deleted from our system.

No refunds will be offered for temporary or permanent loss of Service howsoever arising, including but not limited to a loss of Service due to the UKPAD website being unavailable for whatever reason.

In the event of any error, misprint or omission in the publication of an advertisement or part of an advertisement (however caused) the Publisher will re-publish the advertisement or relevant part of the advertisement as the case may be. No republication, or adjustment will be made where the error, misprint or omission does not materially detract from the advertisement.

Suspension & Termination

Hotmat reserves the right to suspend or terminate (at its sole discretion) the publication of your advertisement on the Site in the event that it is made aware by whatever means that the content is inappropriate, misleading or inaccurate, without liability to you. In such circumstance Hotmat will notify you of the suspension or termination.

Any adverts giving rise to complaint or dispute of any kind shall be suspended pending resolution or otherwise terminated. Hotmat may in its sole discretion reactivate the advertisement upon receipt of satisfactory proof that such a dispute or complaint has been resolved or otherwise satisfied. In no event shall Hotmat be required to act in respect of any dispute or complaint other than to suspend or terminate the advertisement.

Advertisements which infringe any law or regulation (or potentially are infringing), offend or infringe the rights of any third party (including intellectual property rights) will be removed immediately, without warning or liability to Hotmat.

Should we be unable to contact you via the current e-mail address you provide, and it appears this e-mail is no longer functioning, we reserve the right to terminate your advertisement without liability to us.

Hotmat cannot be held responsible for any e-mail problems you experience, whether a result of your Internet Service Provider, the Internet or any other technical issue.

Hotmat reserves the ultimate discretion as to which adverts, if any, are in violation of these terms.

Guarantees

You understand that Hotmat cannot guarantee enquiries or the legitimacy of enquiries as a result of advertising on UKPAD.

While every endeavour will be made to meet the wishes of Advertisers, the Publisher does not guarantee the publication of any particular advertisement or its publication on any particular date.

Limitation of Liability

You agree that you shall indemnify Hotmat in full and hold it harmless for any losses or damages howsoever arising, including claims from third parties, that may result directly or indirectly from any advertisements that you post on the Site.

The total liability of Hotmat to you, howsoever arising under these Terms in respect of the Service, shall be limited (to the extent permitted by law) to the total Fee paid by you for the Service.

Hotmat reserves the right to disclose the name and address of Advertisers to the police, trading standards officials, or any other relevant authority.

Force Majeure

We agree to make reasonable efforts to ensure full performance of Hotmat services. We will not be liable for any failure to provide the Service or to comply with these Terms and Conditions for any cause that is beyond Our reasonable control. We will not be liable for any losses or delays in the transmission of instructions caused by any Internet Service Provider or by software failure or for any indirect or consequential loss you suffer as a result of using this service.

Applicable Law

This site is created and controlled by Hotmat in England, United Kingdom. As such these disclaimers, terms and conditions, shall be governed by and construed in accordance with the laws of England and Wales without giving effect to any principles of conflicts of laws. Disputes arising here from shall be exclusively subject to the jurisdiction of the courts of England and Wales. We reserve the right to make changes to our site and these disclaimers, terms and conditions at any time.
